Terms and conditions

These terms apply when you use this website, book a class or take part in a Pilates session provided by Heidi Monsen Pilates.

Please read them before making a booking. By booking or participating in a session, you confirm that you accept these terms.

About Heidi Monsen Pilates

Pilates classes and private sessions are provided by Heidi Monsen, trading as Heidi Monsen Pilates.

In these terms, “I”, “me” and “my” refer to Heidi Monsen and Heidi Monsen Pilates. “You” and “your” refer to the person making the booking or participating in a session.

Bookings

Mat classes and private sessions may be booked through Gymcatch or directly with me.

A booking is confirmed when you receive a booking confirmation or when I confirm it directly with you. Places are subject to availability.

You are responsible for checking the class date, time, location and suitability before booking.

Gymcatch operates as a separate booking platform and has its own terms and privacy policy. Your contract for the Pilates class or private session remains with Heidi Monsen Pilates.

Bookings are personal to the named client and must not be transferred to another person without my prior agreement.

Prices and payment

Current prices are displayed on the website, through Gymcatch or provided when you make an enquiry.

Unless otherwise agreed, payment is required when booking. A place may not be secured until payment has been received.

Payments made through Gymcatch are handled by the payment provider shown during checkout. Heidi Monsen Pilates does not receive or store your complete payment-card details.

Mat-class bookings

Mat classes are scheduled and purchased as a complete course or term, normally lasting 11 or 12 weeks with a break for half term.

Your booking reserves a place in one particular weekly class—for example, Monday at 9.15am—for the full term.

If you wish to attend two or more classes each week, you must make a separate term booking for each class.

Existing clients are given priority to rebook their regular class for the following term. The priority-booking period and deadline will be communicated before the new term. A place cannot be guaranteed if it is not booked by the stated deadline.
 

Course fees reserve your place for the full term and are not calculated according to the number of classes you attend. Classes missed because of holidays, illness or other personal circumstances are not normally refundable, but you may be able to arrange a make-up class as described below.

Make-up classes

Make-up classes are offered as a courtesy and are always subject to a suitable space being available.

A make-up credit gives you the opportunity to book another class; it does not guarantee that a suitable place will be available.
 

To receive a make-up credit, you must:

  • Cancel your regular class through Gymcatch at least 12 hours before it is due to begin.

  • Use the resulting credit to book an available class shown as a make-up option through Gymcatch.

  • Attend the make-up class during the same term as the class originally missed.
     

Cancellations made with less than 12 hours’ notice, and missed classes where no notice is given, will not receive a make-up credit.

You may arrange make-ups in advance. For example, if you know that you will miss a class later in the term, you can cancel it through Gymcatch and use the resulting credit to attend an available class earlier in the same term.

Make-up classes cannot be carried into a holiday period or a future term. Any unused make-up credits expire at the end of the relevant term and have no cash or refund value.
 

It is your responsibility to cancel your regular class, manage your credits and book make-up sessions through Gymcatch.

Classes are often busiest towards the end of a term, so you are encouraged to arrange make-ups as early as possible and to be flexible about alternative days and times.
 

These rules apply to classes missed by the client. They do not affect your rights if Heidi Monsen Pilates cancels a class or is unable to provide a booked term session.
 

Private sessions

Private studio sessions, including one-to-one and one-to-two sessions, are arranged for a specific date and time.

If you need to cancel or rearrange a private session, please provide at least 24 hours’ notice. With sufficient notice, your payment may be transferred or credited towards another available session.

Cancellations made with less than 24 hours’ notice, and missed appointments where no notice is provided, will normally be charged in full because the reserved time may not be capable of being offered to another client.

Please arrive promptly. If you arrive late, the session will still finish at its original scheduled time so that it does not affect another client’s booking.
 

A significantly late arrival may be treated as a missed session if there is insufficient time to exercise safely.
 

These arrangements do not affect your statutory rights or your entitlement to a replacement, credit or refund if Heidi Monsen Pilates cancels the session.

Cancellations or changes by Heidi Monsen Pilates

Occasionally, I may need to cancel or change a class because of illness, venue availability, safety concerns or other circumstances outside my reasonable control.

If I cancel a session, you will be offered one of the following:

  • A replacement session;

  • A credit towards a future booking; or

  • A refund for the affected session.
     

I will give as much notice as reasonably possible.

I may make reasonable changes to a venue, timetable or class arrangement where necessary. If a change is significant and you cannot reasonably attend the replacement, you may request a credit or refund for the affected session.
 

Cooling-off rights

Bookings for Pilates classes and private sessions taking place on a specific date or during a specified term are leisure services. The usual 14-day cooling-off period for online purchases does not generally apply to these dated bookings.
 

Any additional cancellation rights offered by Heidi Monsen Pilates are described in the relevant cancellation sections above.

Nothing in these terms removes any statutory cancellation right that applies to a particular purchase.

Health information

You must complete the requested client enrolment and health information accurately before participating.

Please tell me before a session about any relevant:

  • Injury, pain or restriction in movement;

  • Medical condition;

  • Surgery or medical treatment;

  • Pregnancy or recent childbirth;

  • Medication that might affect your ability to exercise; or

  • Change in your health since completing your enrolment form.
     

If you are unsure whether Pilates is appropriate for you, you should seek advice from your GP, physiotherapist or another suitably qualified healthcare professional before participating.

I may ask you to obtain medical clearance before taking part if I reasonably believe this is necessary for your safety.

Pilates instruction is not a substitute for medical diagnosis, advice or treatment.

Participation and safety

You agree to:

  • Follow reasonable instructions given during the session.

  • Exercise at a level appropriate for your ability.

  • Stop exercising and tell me immediately if you experience pain, dizziness, breathlessness or unusual discomfort.

  • Wear suitable clothing and use equipment only as instructed.

  • Avoid participating while under the influence of alcohol, recreational drugs or anything else that could make exercising unsafe.

  • Behave respectfully towards the instructor and other participants.
     

I may adapt an exercise, ask you to stop or refuse participation where I reasonably believe that continuing would create a safety risk.

If participation is refused because you have withheld relevant information, ignored safety instructions, arrived too late to participate safely or are under the influence of alcohol or drugs, the session may still be charged.

Hands-on correction

Pilates instruction can involve hands-on guidance to help with positioning, alignment or safe movement.

I will seek your agreement before using hands-on correction. You may decline or withdraw that agreement at any time without needing to provide a reason.

Children and young people

Anyone under the age of 18 must have their booking and enrolment information completed or approved by a parent or legal guardian.

The parent or guardian is responsible for ensuring that relevant health information is accurate and that the young person understands and follows the instructor’s safety guidance.

I may require a parent or guardian to remain present, depending on the participant’s age and the type of session.

Exercise risks and results

All physical exercise involves some risk of strain, injury or discomfort, even when exercises are performed correctly.

You are responsible for working within your own capabilities, following safety instructions and providing accurate information about matters that could affect your participation.

Individual results vary. I cannot guarantee that Pilates will achieve a particular medical, fitness, mobility or appearance-related result.

Liability

I will provide Pilates instruction with reasonable care and skill.

Nothing in these terms excludes or limits liability where doing so would be unlawful. In particular, nothing excludes or limits liability for:

  • Death or personal injury caused by negligence;

  • Fraud or fraudulent misrepresentation; or

  • Your statutory consumer rights.

I am not responsible for an injury or loss caused by inaccurate or withheld health information, participation against medical advice, failure to follow reasonable safety instructions or use of equipment in a way that has not been authorised.
 

I am not responsible for loss or damage that was not reasonably foreseeable, unless it resulted from a breach of these terms or my legal duties.

Pilates services are supplied for personal use. I am not responsible for business losses, loss of profit or loss of commercial opportunity.
 

Personal belongings

Please take reasonable care of personal belongings brought to a class or private studio.

I cannot accept responsibility for loss, theft or damage unless it results from my negligence or a failure to take reasonable care.

Photographs and videos

I will ask for permission before taking or publishing an identifiable photograph or video of you for marketing or promotional purposes.

You may refuse permission without affecting your ability to attend classes. Permission may be withdrawn for future use at any time.

Participants must not photograph or record other clients without their permission and my prior agreement.

Website information

Information on this website is provided for general information and should not be treated as medical advice.

I make reasonable efforts to keep class details, prices and availability accurate. Occasionally, information may need to be corrected or updated.

Any Pilates videos or exercise demonstrations available through the website provide general guidance and are not individually assessed or adapted for you.

Before following a video, you are responsible for ensuring that you have a suitable space, that any equipment is safe and that the exercises are appropriate for your health and level of experience. Stop immediately if you experience pain, dizziness or unusual discomfort.

Links to Gymcatch, social media platforms and other external websites are provided for convenience. I am not responsible for the content or availability of external websites.

Website content and intellectual property

Unless otherwise stated, the text, branding, photographs, videos and other original material on this website belong to Heidi Monsen Pilates or are used with permission.

You may view the website and print reasonable extracts for personal use.

You must not reproduce, distribute, sell or commercially exploit its content without prior written permission.

Pilates videos and teaching materials are provided only for the purpose for which they were supplied. They must not be copied, recorded, redistributed or used to provide instruction to others.

Privacy

Personal information is handled in accordance with the Heidi Monsen Pilates

Privacy Policy.

Health information is used only where necessary to assess suitability, adapt sessions, protect safety and meet legal or insurance requirements.

Changes to these terms

I may update these terms when services, booking arrangements or legal requirements change.

Changes will normally apply only to bookings made after the revised terms are published. A material change will not be applied retrospectively to an existing booking unless required by law or agreed with you.

The revision date at the top of this page shows when the terms were last updated.

Governing law

These terms are governed by the laws of England and Wales.

The courts of England and Wales will normally have jurisdiction. If you live elsewhere in the United Kingdom, you retain any mandatory rights to bring proceedings in your local courts.
